Let us understand the J&K Public Service Guarantee Act?

At some point or the other, we come across a situation when we have to make several runs to the Government Offices for availing certain services which are either delayed or denied to us on some pretext or the other.

That is a thing of past if you are aware of your rights.

Background

The Government of India gave us the Right to Public Service Legislation. The sole purpose of this legislation is to guarantee the services asked for in a time-bound manner and to fix the accountability in case of delay by the Government office.

In Jammu and Kashmir, this law is popularly known as the Public Service Guarantee Act 2011.

The Public Service Guarantee Act 2011 was passed in J&K on 10th August 2011. It has given the right to people to make an appeal if the services asked for are delayed or denied in any manner.

Any person whose application has been rejected, delayed within specified timeframe or is deficient can file an appeal to the First Appellate Authority within 30 days of such rejection, delay or deficiency in service provided.

The Appellate Authority

The First Appellate Authority shall dispose of the appeal within a period of 45 days from the date of presentation of appeal.

Even if, the applicant seeking the information is not satisfied with the response from the First Appellate Authority he may re appeal to the Second Appellate Authority within 60 days from the date of the last order passed.

It is important to know here that the Appellate Authorities shall have the same power as that vested in Civil Court while trying a suit under the Code of Civil Procedure.

Penalty Provision

If the designated officer does not comply with the orders he may be fined Rs. 250 to Rs. 5000 in case of not providing or delaying the service to the eligible person asking for service. Also, there will be a provision of imposing penalty of Rs. 2000 in case of deficiency in service by the concerned Appellate Authority.

Only 80 services are covered in J&K while Bihar covers around 750 services. Tatkal service is not available as in the State of Bihar which would be really beneficial. The time bound service provision and Penalty provision for the erring officers is commendable.J&K Public Services Guarantee Act, 2011
